Inhabitability or loss of rent

When the business premises become uninhabitable as a result of a claim covered by the policy, we will pay compensation for the time that is necessary to repair or rebuild the business premises, up to a maximum period of one year:

  • If the insured party is the owner and user of the business premises, the expenses arising for the insured party from the possible transfer of the rescued goods, should the contents be covered, and the lease that must be paid for other premises of similar characteristics.
  • If the insured party is the owner and leases the site, the loss of the lease payments that the insured party has been receiving for the lease thereof.
  • If the insured party is the lessee: the expenses arising for the insured party in relation to the possible transfer of the rescued items and the difference between the lease that it was paying and that of other business premises of similar characteristics that must be paid.
Acts of vandalism, tumultuous action and legal strikes
  • Acts of vandalism, committed individually or collectively by persons other than the insured party, the policyholder or the dependent parties, family members, tenants, and people that have an employment relationship or live with the insured party and/or policyholder.
  • Tumultuous actions arising in the course of meetings and demonstrations in conformity with Organic Law 9/1983, of 15 July, and during legal strikes, except in the case of riots and popular uprisings.
Severe weather conditions
  • Rain exceeding 40 l/m²/hour.
  • Wind exceeding 96 km/h and up to 120 km/h.
  • Hail or snow.
  • Flooding as a result of the overflow or diversion from their normal course of lakes without a natural outflow, canals, irrigation ditches and other surface courses built by man, drains, sewers and other underground courses caused by overflow, bursting, breakage or breakdown.
  • Expenses arising from removing mud and extracting sludge as a result of a claim are also covered.

Expenses relating to the substitution, erection, and assembly due to accidental breakage of:

  • Glass, methacrylate, flat window panels and mirrors such as doors, windows, skylights, roof lights, and sanitary fittings.
  • Window panes, methacrylate, marble, granite, and other natural or artificial stones that form part of the furniture, and signs and illuminations of the business activity.
Replacement of public documents and IT programs
  • The obtaining of the corresponding duplicates of public documents and deeds held.
  • The replacement of IT programs in force on the market and which are used in business activities, provided that the insured party is the holder or has the corresponding legal license of the owner to become an end-user (licensed software).
Third-party liability as a property owner.

Personal injury or property damage or direct losses caused to third parties as a result of:

  • The insured contents.
  • Damage arising from minor work and duly authorized repair, maintenance or decoration work that does not exceed the amount indicated in the Specific Terms and Conditions of the policy.

Operating third-party liability

Personal injury or property damage or direct losses caused to third parties in the performance of the insured business activity provided that it is caused by:

  • Damage caused by the performance of work or the provision of the services constituting the insured business activity, occurring within the insured business premises or at the customer’s home, prior to the delivery or provision of works or services.
  • Fire, explosion, smoke, water, gas, odors, vapor, and sinking of land occurring at the property or business premises at which the insured party carries on its insured activity.
  • Transportation and/or transported goods, both using vehicles belonging to the insured parties and to third parties and/or by railway, together with loading, unloading, transfer, and storage operations.
  • The cloakroom service with respect to the garments and items entrusted, if it has a permanent surveillance system, its access is restricted and, furthermore, tickets or receipts are given to the customers.
  • The loss, wear and tear or change of garments handed in by customers to be washed, ironed, repaired, or other actions requiring the deposit and safeguarding of items.
  • The organization and functioning of fire extinction services (even when they help or collaborate with other companies, municipal councils, etc.), sports games, outings, educational visits, residences, recreational or leisure sporting facilities, bar or lunch services, canteens, and security or surveillance services.
  • The use of machinery, tools, equipment, or other items required to perform the insured activity, provided that it complies with the conditions of use which, where appropriate, are demanded by the prevailing regulations.
  • Access to the insured property or business premises of customers, visitors, suppliers, and any duly authorized person.
  • Participation of the insured party in fairs and exhibitions provided that the duration does not exceed one month.
Product / Post-work third-party liability

Personal injury or property damage or direct losses caused to third parties as a result of:

  • Products or goods after they have been delivered or supplied to third parties. For the purposes of this policy, products will be considered to have been delivered once the insured party has lost the power to use them.
  • Food poisoning caused by food or beverages supplied or delivered by the insured party at the insured business premises.
  • Work or services after they have been delivered or supplied to third parties. For the purposes of this policy, work will be deemed to have been delivered upon the acceptance without reservation by the owner of the construction work, assembly, or facility.
Third-party liability arising from occupational accidents

Personal injury suffered by its employees as a result of occupational accidents occurring as a result of the performance of their work, provided that such liability has been declared by a final legal ruling and, furthermore, the National Social Security Institute – or the remaining competent partnership entities – have acknowledged any benefits for said occupational accident to the affected party itself or its heirs.

  • Electrical or electronic devices less than 10 years old and damage to refrigeration devices less than 20 years old, at the time of the claim, that form part of the insured contents, provided that they are located at the business premises, are used directly in business activities and are not earmarked for mere preparation, manufacture, repair or marketing purposes.
Breakdown of machinery

Breakdowns or damage to electrical or electronic devices less than 10 years old and damage to refrigeration devices less than 20 years old, at the time of the claim, arising from a sudden and accidental cause, other than those indicated in the remaining coverage of these General Terms and Conditions (taken out or otherwise), provided that they form part of the insured contents, are used directly in business activities and are not earmarked for mere preparation, manufacture, repair or marketing purposes.

Damage to merchandise in refrigeration chambers

Direct damage suffered by goods and products used in business activities, contained in refrigeration chambers located at the business premises, which have been caused by:

  • Breakdown in refrigeration installations or failure of their automatic controls.
  • Unexpected interruptions in the public energy supply that exceed six hours.
  • Paralyzation of the refrigeration chamber due to the occurrence of a claim covered by the policy.
  • Smoke pollution or the action of refrigeration gasses from refrigeration machines, following a leak for whatever cause.
Damage to computers and hardware
  • Direct damage which for accidental, sudden or unforeseen causes, affects the computers and IT equipment located at the business premises, provided that they form part of the insured contents, are used directly in the business activity and are not earmarked for preparation, manufacture, repair or marketing.
  • The cost of replacing information contained in the medium for normal use, such as magnetic strips or drives, which are lost as a result of damage to computers and IT equipment, covered by the policy, and the repair costs for such medium.
  • The expenses which, for a maximum period of one month, the insured party accredits that it has incurred to lease a similar computer, as a result of the disablement of the insured equipment following a claim that can be compensated for this coverage.
